Summary
The court held that Speer was not entitled to a duress instruction because his own testimony showed opportunities to leave the robbery plan, seek police protection, and avoid committing the crime. It also held that airport security employees of the Department of Homeland Security and Transportation Security Administration were not employees of a public law enforcement agency subject to automatic challenge for cause. The court reversed the court of appeals and remanded for reinstatement of the conviction. Justice Márquez, dissenting, would have held that Speer presented sufficient evidence for a duress instruction and would have affirmed the reversal and remanded for a new trial.
