Summary

The court held that Colorado was not required to recognize or enforce Nebraska's initial child-custody determination because Nebraska lacked jurisdiction under both Nebraska law and the PKPA. Nebraska was not the child's home state when the custody proceeding began, and Colorado had not properly declined jurisdiction on the ground that Nebraska was the more appropriate forum. The court therefore reversed the court of appeals and remanded for further proceedings.
