Supreme Court of Colorado
Concerning the Application for Water Rights of Cherokee Metropolitan District in El Paso County, Colorado, Cherokee…
December 12, 2011266 P.3d 401
Summary
The court held that Meridian had a right to intervene as of right because it claimed an interest in reuse of wastewater return flows, the declaratory judgment could practically impair that interest, and Cherokee did not adequately represent Meridian. Because Meridian was denied participation before the declaratory judgment was entered, the court reversed the denial of intervention, vacated the declaratory judgment, and remanded for the proceedings to be reopened. No separate opinions were filed.
