Summary
Justice Eid concurred in the conclusion that recovery of trust funds under the Trust Fund Statute is assignable on a contingency-fee basis, but dissented from the determination that Adams engaged in the unauthorized practice of law after January 1, 2007. She reasoned that the 2006 assignments fully transferred the claims to Adams and that pursuing an ultimately unassignable damages component would affect recoverability, not convert his conduct into unauthorized legal representation. She also would not impose costs or fines. As a separate opinion, it does not establish the court's holding.
