Summary

The dissent would reverse the suppression of the cocaine and the defendant's post-Miranda statements. It reasons that the officers had reasonable articulable suspicion to conduct an investigatory stop, that the defendant's refusal to comply supplied probable cause for arrest, and that the search was valid as incident to that arrest. It also concludes that the record did not support suppression of the later statements as involuntary. Justice EID, concurring in part and dissenting in part, would affirm suppression of the statements but agree that the contraband should not have been suppressed.
