Supreme Court of Colorado

The People of the State of Colorado, Plaintiff-Appellant v. Stephen Lamarr Minor, Defendant-Appellee

February 1, 2010222 P.3d 952

Summary

The court reversed the suppression order because the defendant, although not the vehicle's owner, had control over the vehicle and validly consented to an unlimited search. Under an objective-reasonableness standard, that consent extended to the trunk and an unlocked, zipped backpack capable of containing drugs. The marijuana discovered in the backpack and the defendant's subsequent statements were therefore admissible at trial.
