Justice Eid dissented from the majority's conclusion that the prosecutor's repeated use of the word "lie" constituted plain error. The dissent agreed that the prosecutor violated the categorical prohibition on that term but concluded that the remarks did not fundamentally undermine the fairness of the trial because Wend admitted misleading police and her counsel repeatedly characterized her statements as lies. The dissent would therefore decline to reverse the conviction.
