Summary

The court held that the California Public Records Act permits declaratory relief even after an agency has disclosed all existing responsive, nonexempt records when the declaration would resolve an ongoing dispute likely to affect future records requests or related conduct. It also held that the Act does not impose a three-year duty to preserve records withheld under an exemption. The court therefore reversed the Court of Appeal insofar as it narrowly limited declaratory relief and remanded for further proceedings.
