Summary

The court affirmed Hin’s murder conviction, reversed all six attempted-murder convictions, reversed the criminal-street-gang participation conviction, and vacated the gang-murder special-circumstance finding. It held that instructional errors involving invalid theories of murder liability were harmless for the murder conviction but not for the attempted-murder convictions, and that the evidence was insufficient to establish intent to kill two victims inside residences under the properly instructed aiding-and-abetting theory. The court also rejected Hin’s challenges to disclosure of a codefendant’s psychological reports, custodial statements, and severance. The opinion has no separate writings.
