Summary

The court held that the evidence did not establish beyond a reasonable doubt that Emanuel acted with reckless indifference to human life under the amended felony-murder statute. Emanuel planned an unarmed, daylight robbery in a public place, did not know his accomplice was armed or likely to use lethal force, attempted to leave when the victim resisted, and had no meaningful opportunity to prevent the sudden shooting. The court reversed and directed the trial court to grant resentencing relief, vacate the murder conviction, and resentence Emanuel.
