Summary
The court held that Alameda Health System is a public entity and therefore is exempt from the Labor Code and applicable wage-order requirements governing meal and rest breaks, associated payroll records, and specified wage-payment obligations. It also held that public employers are not subject to civil penalties under PAGA, including penalties for violations that otherwise carry specified statutory penalties. The court reversed the Court of Appeal and directed reinstatement of the trial court's order sustaining the demurrer without leave to amend.
