Summary
The court affirmed Lamb's convictions and rulings on most guilt-phase claims, including denial of severance, admission of the Fox videos and jailhouse statement, alleged firearm-expert and prosecutorial errors, and the conspiracy conviction. It reversed the street-terrorism and loaded-firearm convictions and the gang enhancements and gang-murder special-circumstance finding because the jury was not instructed on Assembly Bill No. 333's requirements concerning gang benefit, and it vacated the death judgment and remanded for possible retrial of those matters. The court also held that any instructional error concerning the omitted gang-benefit element was not harmless beyond a reasonable doubt on the record presented.
