California Supreme Court

Meinhardt v. City of Sunnyvale

July 29, 2024

Summary

The court held that, in administrative mandate proceedings, the time to appeal begins upon entry of a document denominated a judgment or service of notice of entry of judgment, not upon filing or service of an order or other ruling. Because the appeal was filed within the applicable period measured from the later judgment, the Court of Appeal erred in dismissing it as untimely. The court reversed and remanded for further proceedings.
