Summary

The court held that the policy's Limited Fungi, Bacteria or Virus Coverage endorsement unambiguously provides coverage only when a virus results from a specified cause of loss, and that limitation is enforceable. John’s Grill could not satisfy that limitation and failed to establish that the policy's virus coverage was illusory under any potentially applicable doctrine. The court reversed the Court of Appeal and remanded for further proceedings; although the parties had settled, the court addressed the technically moot issues because they were matters of continuing public interest likely to recur.
