Summary
The court held that Business and Professions Code section 7451, enacted by Proposition 22, does not conflict with article XIV, section 4 of the California Constitution. The constitutional grant of plenary workers’ compensation power to the Legislature is not exclusive of the electorate’s reserved initiative power, and section 7451 itself does not restrict the Legislature from enacting future workers’ compensation laws. The court expressly left unresolved whether other provisions of Proposition 22 improperly constrain future legislative action.
