California Supreme Court
People v. Reyes
June 29, 2023
Summary
The court held that the trial court improperly denied Reyes’s resentencing petition because the evidence did not support murder liability under a direct-perpetrator theory, and the court applied the wrong legal requirements to any direct-aiding-and-abetting theory. Direct aiding and abetting implied-malice murder remains legally valid, but the aider must aid the life-endangering act and personally possess the required knowledge and mental state concerning that act. The judgment was reversed and remanded for further proceedings under the correct standards.
