California Supreme Court

In re D.P.

January 19, 2023

Summary

The court held that the father’s challenge to the juvenile court’s jurisdictional finding became moot after dependency jurisdiction terminated because he failed to show a specific legal or practical consequence that reversal would redress. It also held that a reviewing court may nevertheless exercise discretion to decide the merits of a moot dependency appeal, and that the Court of Appeal applied the wrong standard in refusing to consider that discretion. The judgment dismissing the appeal was reversed and remanded for reconsideration of discretionary review.
