Summary

The California Supreme Court held that California's common-law fair-procedure doctrine requires a private university to provide an accused student with notice of the charges and a meaningful opportunity to respond, but does not require a live hearing with direct or indirect cross-examination of the accuser and other witnesses. Because the university gave Boermeester multiple opportunities to review and respond to the evidence, its procedures were not rendered unfair by the absence of live cross-examination. The court reversed the Court of Appeal's judgment and remanded for consideration of Boermeester's remaining claims.
