Summary

The court affirmed defendant’s convictions and death sentence, holding that the trial court properly ordered concealed physical restraints based on extensive evidence of violence, weapons possession, and threats against witnesses. It also upheld the excusal of two prospective jurors, rejected challenges to the death-qualification process and California’s capital sentencing scheme, and found that defendant knowingly chose not to present mitigating evidence. Although defendant’s absence during part of voir dire violated statutory written-waiver requirements, the error was harmless and his constitutional right to be present was waived.
