Summary

The court held that the Department of Corrections and Rehabilitation validly excluded inmates currently serving a term for a violent felony from Proposition 57 early parole consideration, even when they also have nonviolent felony convictions. The constitutional text was ambiguous on that question, and the Department's regulation was reasonably consistent with the text, ballot materials, public-safety purpose, and its delegated rulemaking authority. The court therefore reversed the Court of Appeal's judgment.
