Summary

The court held that the rule limiting sentencing courts to facts necessarily established by a prior conviction or admitted as part of a guilty plea is a new procedural rule. Because the rule is procedural and does not apply retroactively under either the federal or California retroactivity framework, it does not disturb petitioner's final judgment.
