Summary

The court held that the rule limiting sentencing courts to facts necessarily established by a prior conviction or admitted as part of a guilty plea is a new procedural rule. Because the rule is procedural and does not apply retroactively under either the federal or California retroactivity framework, it does not disturb petitioner's final judgment. The court therefore affirmed denial of habeas relief.
