California Supreme Court

Hoffmann v. Young 8/29/SC Case Details

August 29, 2022

Summary

The court held that the recreational-use immunity exception applies when a landowner or an authorized agent acting on the landowner's behalf expressly invites a person onto the property. A live-at-home child's invitation does not automatically qualify merely because the parents permitted the child to live there and did not prohibit invitations, and plaintiff did not show that the child was authorized to act for the landowners. The court reversed and remanded for consideration of plaintiff's unresolved challenge to the denial of a new trial.
