Summary

The court held that traditional LPS conservatees and persons facing extended NGI commitments are sufficiently similarly situated for purposes of the statutory right against compelled testimony, triggering equal protection review. It did not decide the applicable level of scrutiny or whether the disparate treatment is justified because any error in compelling Eric B.'s testimony was harmless under either the state or federal standard. The court therefore affirmed the Court of Appeal's judgment.
