California Supreme Court
People v. Super. Ct. (Jones)
December 2, 2021
Summary
The court held that the prosecution impliedly waived work product protection over jury-selection notes by relying on an undisclosed juror-rating system to justify peremptory strikes during the Batson/Wheeler hearing. Because the notes were necessary to fairly evaluate the prosecutor’s stated reasons, they were discoverable in postconviction proceedings, subject to redaction of unrelated core work product. The court affirmed the Court of Appeal’s judgment and remanded for further proceedings consistent with its opinion.
