California Supreme Court
Rockefeller Technology etc. v. Changzhou SinoType Technology etc.
April 2, 2020
Summary
The court held that the Hague Service Convention did not apply to the parties' agreement because California law permitted them to waive formal service of process and substitute notification by Federal Express or a similar courier. The parties also consented to California personal jurisdiction by agreeing to California arbitration and jurisdiction in California courts. The court reversed the Court of Appeal and remanded for resolution of unadjudicated issues.
