California Supreme Court

Gund v. County of Trinity

August 27, 2020

Summary

The court held that civilians who respond to a peace officer’s request to check on an unspecified 911 emergency are engaged in active law enforcement service under Labor Code section 3366. Because the Gunds were injured while performing that requested task, workers’ compensation was their exclusive state-law remedy, notwithstanding alleged misrepresentations or omissions about the danger. The court therefore affirmed the Court of Appeal’s judgment.
