Summary

The court held that Civil Code section 1431.2 does not permit an intentional tortfeasor to reduce liability for noneconomic damages based on negligence attributable to the plaintiff, codefendants, injured parties, or nonparties. Because the deputy's liability arose from battery, the jury's allocation of only 20 percent fault did not limit his liability for the full noneconomic damages award. The court therefore reversed the Court of Appeal's judgment and remanded for further proceedings consistent with its opinion.
