Summary

The court held that the constitutional Right-to-Truth-in-Evidence provision abrogated Penal Code section 632(d) to the extent it would exclude relevant evidence in a criminal proceeding. Later legislative reenactments and amendments to section 632 did not revive that exclusionary remedy because they did not demonstrate legislative intent to do so, and one amendment lacked the required two-thirds vote. The court therefore affirmed the judgment admitting the secretly recorded conversation and affirming defendant's convictions.
