Summary

The court affirmed the denial of Mario Martinez’s Proposition 47 resentencing petition for his felony methamphetamine transportation conviction. Although eligibility is not limited to convictions under the statutes listed in Penal Code section 1170.18, Martinez was ineligible because Proposition 47 did not reclassify drug transportation under Health and Safety Code section 11379. The Legislature’s 2013 amendment limiting transportation to transportation for sale did not apply retroactively to Martinez’s final conviction.
