Summary
The court held that a forgery conviction is excluded from Proposition 47 misdemeanor resentencing under Penal Code section 473(b) only when the forgery and identity theft convictions arise from conduct sufficiently connected to each other. Because Gonzales's forgery conduct occurred in 2003 and his unrelated identity theft conduct occurred in 2006 and 2007, his forgery convictions remained eligible for resentencing. The court affirmed the Court of Appeal and remanded for further proceedings.
