Summary

The California Supreme Court held that the project’s environmental impact report was inadequate because it did not reasonably connect projected air pollutant emissions to likely human-health consequences or explain why such a connection was not scientifically feasible. The court upheld the EIR’s mitigation measures as sufficiently specific and enforceable, rejected claims that future substitution of equally or more effective measures impermissibly deferred mitigation, and held that mitigation need not reduce significant impacts below the level of significance. The court affirmed in part, reversed in part, and remanded for further proceedings.
