California Supreme Court
County of Los Angeles, Plaintiff and Appellant v. Financial Casualty & Surety, Inc., Defendant and Respondent.
June 25, 2018234 Cal. Rptr. 3d 459
Summary
The court held that when authorized jail personnel set a time and place for a defendant's appearance under section 1269b(a), that appearance is lawfully required for purposes of bail forfeiture under section 1305. The statutory cross-reference in section 1269b(h), together with the 1976 legislative amendment, establishes a single mandatory forfeiture procedure and does not require a separate court order. The court therefore reversed the judgment setting aside the forfeiture and remanded for further proceedings.
