Summary
The court held that every negotiated plea agreement in adult or juvenile court includes an implied term that, absent a waiver, the judge who accepts the plea will impose the sentence or disposition when the judge retains sentencing discretion. Because the Court of Appeal required K.R. to prove a subjective expectation of sentencing before the same judge, the court reversed and remanded with directions to grant K.R.'s writ petition.
