Summary

The court held that every plea agreement in adult or juvenile court implicitly guarantees that the judge who accepts the plea will impose the sentence or disposition, unless the defendant or juvenile waives that right. A defendant need not prove a subjective expectation that the same judge would preside. Because the Court of Appeal applied the contrary expectation-based rule, the court reversed and remanded with directions to grant K.R.'s writ petition.
