California Supreme Court

The People, Plaintiff and Respondent v. Reynaldo Junior Eid, Defendants and Appellants

July 10, 201459 Cal. 4th 650

Summary

The court held that a jury may convict a defendant of multiple uncharged lesser included offenses of a single charged greater offense when the lesser offenses are not themselves included in one another. Because attempted extortion and misdemeanor false imprisonment were separate lesser offenses supported by the evidence, the defendants were properly convicted of both. The court therefore reversed the Court of Appeal's decision striking the false-imprisonment convictions.
