California Supreme Court
The People, Plaintiff and Respondent v. Rayshon Derrick Thomas, Defendant and Appellant
May 3, 201253 Cal. 4th 1276
Summary
The court held that Madera County was a proper venue for prosecuting defendant’s possession-for-sale and felon-in-possession offenses, even though the drugs and firearm were stored in Fresno County. Under Penal Code section 781, venue may rest on preparatory acts and on effects of the charged conduct that occur in the prosecuting county, including conduct showing that Madera was the defendant’s base of operations. The court reversed the Court of Appeal’s judgment and remanded for consideration of the defendant’s remaining claims.
