California Supreme Court

The People, Plaintiff and Respondent v. Brandon Alexander Favor, Defendant and Appellant — Liu, J., Dissenting

July 16, 201254 Cal. 4th 868

Summary

Justice Liu dissented from the court's conclusion that a defendant could be convicted of premeditated attempted murder under the natural-and-probable-consequences doctrine without a jury finding that premeditation itself was reasonably foreseeable from the target robbery. She would hold that the omission violated the required jury determination of the causal link between the target and charged offenses and would remand for the Court of Appeal to assess prejudice.
