Summary

The court held that a driver who stops a vehicle alongside a freeway remains subject to the general duty of ordinary care toward other motorists and rejected a categorical no-duty rule for nonemergency stops. It also held that substantial evidence supported the jury's finding that the stopped truck was a substantial factor in causing the collision. The court therefore reversed the Court of Appeal's judgment granting judgment notwithstanding the verdict.
