California Supreme Court
Century-National Insurance Co., Plaintiff and Respondent v. Jesus Garcia, Defendants and Appellants
February 17, 201151 Cal. 4th 564
Summary
The court held that a homeowners policy exclusion for losses caused by the intentional or criminal conduct of "any insured" could not be enforced against innocent coinsureds when the policy was subject to California's statutory standard fire-policy requirements. Because the exclusion provided materially less protection than the statutory standard form, it was invalid to that extent. The court reversed the appellate judgment and remanded for further proceedings.
