California Supreme Court
In Re Nathan Pope on Habeas Corpus
August 19, 201050 Cal. 4th 777
Summary
The court held that a prisoner convicted of qualifying violent felonies remains subject to the 15 percent worktime-credit limitation even when execution of sentence for those felonies is stayed under section 654 and the prisoner is serving a longer sentence for a nonqualifying offense. A stayed sentence does not eliminate the underlying convictions or the state's potential claim to custody under those convictions. The court affirmed the Court of Appeal's judgment.
