Summary

The court held that Act 975 of 2025 is unconstitutional because it assigns the Arkansas Court of Appeals original jurisdiction over facial constitutional challenges, contrary to the Arkansas Constitution's allocation of appellate jurisdiction to that court and original jurisdiction over justiciable matters to circuit courts. The court further held that the General Assembly cannot use its authority over procedural rules to alter constitutionally fixed jurisdiction. It therefore reversed the dismissal of the complaint and remanded for further proceedings; no separate opinions were filed.
