Supreme Court of Arkansas
Benton School District; Lori Bacon
March 12, 20262026 Ark. 53
Summary
The court held that Greer could not pursue a Rehabilitation Act employment-retaliation claim against the school district because she was employed by a staffing company rather than the District. It also held that her official-capacity claims failed for lack of a District policy or custom and that her individual-capacity ACRA retaliation claims failed because her complaint about her own child was not speech on a matter of public concern under the applicable government-contractor framework. The court reversed the summary-judgment rulings, reversed the damages award, vacated the injunction, and remanded for entry of judgment for the appellants.
