Summary

The Supreme Court of Arkansas held that the circuit court had jurisdiction to impose a fine-only sentence and that the State properly appealed the allegedly illegal sentence. Construing the habitual-offender statute in effect when Mason committed the offense, the court held that its use of the word "may" permitted a fine, imprisonment, or both. The court therefore affirmed the $10,000 fine-only sentence.
