Summary
The court held that Cherokee Nation Businesses was entitled to intervene as of right in Gulfside's challenge to the denial of Gulfside's casino-license application. Cherokee had a recognized interest in the license, its application, and its economic-development agreement, those interests could be impaired by Gulfside's requested relief, and the existing defendants did not adequately represent all of Cherokee's interests. The court rejected the mootness argument, reversed the denial of intervention, vacated subsequent orders, and remanded.
