Supreme Court of Arkansas
Jorja Trading, Inc.; Automatic Auto Finance, Inc.; Cashfish Motor Pawn, Inc.; Virginia Rivers; Monte Johnston; And…
April 9, 2020598 S.W.3d 1
Summary
The court held that the installment-sales contract and its arbitration agreement were supported by mutual obligations, and that the challenged self-help, class-action-waiver, and arbitrator-selection provisions did not invalidate the agreement. It also held that the creditor did not waive arbitration by first seeking a monetary judgment in small-claims court because the contract expressly preserved that right. The court reversed and remanded, and vacated the court of appeals' opinion.
