Supreme Court of Arkansas
Joe Perry, Jr. v. State of Arkansas
January 23, 20202020 Ark. 32
Summary
The court affirmed the denial of Perry’s petition to proceed in forma pauperis because his underlying petition for judicial review of prison disciplinary proceedings did not allege a colorable cause of action. Although constitutional violations may be reviewed despite the general bar on judicial review of ADC administrative complaints, Perry alleged only violations of ADC policy and identified no atypical and significant deprivation implicating a liberty interest. The court therefore found no abuse of discretion.
