Justice Hart dissented, concluding that the cross-appeal should not have been dismissed because the circuit court's order dismissed St. Vincent while allowing claims against the individual employees to continue. She would have held that the alleged conduct did not meet the legal threshold for outrage and that St. Vincent's vicarious-liability defense presented factual questions inappropriate for summary judgment. She also maintained that the circuit court improperly treated whether conduct was extreme and outrageous as a jury question.
