Supreme Court of Arkansas
Jefferson County Election Commission Stu Soffer
May 24, 2018547 S.W.3d 58
Summary
The court reversed the circuit court's writ of mandamus because the election coordinator had no statutory election-related duties and therefore no clearly established right to election information, access, or county property. The court also rejected affirmance on certiorari grounds because the election commission had not abused its discretion, acted outside its jurisdiction, or committed an error apparent on the face of the record. Justice Wood, dissenting, would have affirmed the narrow order requiring the commission to perform its statutory duties and provide the coordinator necessary access.
