Summary

The court held that applying the parole-eligibility law in effect when Davis committed his 1991 aggravated-robbery offense did not violate the prohibition against ex post facto laws. It nevertheless held that the ADC improperly counted Davis's Class C perjury conviction as a qualifying felony and therefore incorrectly classified him as a fourth offender. The court affirmed in part, reversed in part, and remanded for correction of the classification.
