Supreme Court of Arkansas
Arkansas Game and Fish Commission, Public Employee Claims Division and Death & Permanent Total Disab — Kemp, J…
March 29, 2018541 S.W.3d 422
Summary
The dissent would reverse the Commission's decision requiring the employer to pay the claimant's one-half share of attorney's fees when a statutory offset eliminated any additional compensation payable to him. It reasons that the attorney-fee provision and the offset provision can be read harmoniously and that, under strict construction, the court may not add a requirement that the employer pay all fees when no compensation is due. Justices Wood and Womack joined the dissent.
